Delivery and payment conditions

1. Applicability
1.1 These General Terms and Conditions of Sale (hereinafter: Terms and Conditions) apply to all offers, orders and agreements from our OnlineMart Onlinemart.nl, to the exclusion of any other general terms and conditions. These Terms and Conditions have been filed with the Chamber of Commerce in Arnhem and will be sent by us upon request.

1.2 Accepting an offer or placing an order means that you accept the applicability of these Terms and Conditions.

1.3 The provisions of these Terms and Conditions can only be deviated from in writing, in which case the other provisions will remain in full force.

1.4 All rights and claims, as stipulated in these Terms and Conditions and in any further agreements for the benefit of our Onlinemart.nl, are also stipulated for the benefit of intermediaries and other third parties engaged by our OnlineMart Onlinemart.nl.

2. Agreement
2.1 An agreement is only concluded after acceptance of your order by our Party Shop Onlinemart.nl is entitled to refuse orders or to attach certain conditions to the delivery, unless expressly stated otherwise. If an order is not accepted, our Party Shop will inform Onlinemart.nl within ten (10) working days of receiving the order.

3. Distance Buying Act
3.1 The product must be delivered to the consumer no later than 30 days after ordering. If this does not happen, the consumer can immediately cancel the purchase. This does not apply if the parties have agreed on a different delivery period.

3.2 If the consumer returns the product within the cooling-off period, the seller is obliged to refund the amount paid within 30 days.

4. Prices/Offers
4.1 All offers from our OnlineMart Onlinemart.nl are without obligation and our OnlineMart Onlinemart.nl expressly reserves the right to change the prices, especially when this is necessary based on (legal) regulations.

4.2 All prices are stated in € [euros] [including] VAT

4.3 Shipping costs
► For orders under €9.95 we add a small surcharge of €1.95. This surcharge is necessary to somewhat cover the costs we incur for processing a small order.
► Shipping within the Netherlands is done via PostNL and the shipping costs are €6.05 per shipment. We do not charge shipping costs within the Netherlands for orders over 100 euros. If you pick up the order in our store, you will of course not pay any shipping costs.

5. Returns

5.1 You can return all items* within 15 days of receipt, after which you will receive a refund. However, it is expressly stated that the seal/packaging of the items must not be broken and the items must be delivered to Onlinemart.nl in an undamaged condition. This is in accordance with the Distance Selling Act. If this aspect is not taken into account, we unfortunately cannot take back the items and cannot cancel the payment. Consumers can use our Cheap Returns service, where a contribution to the shipping costs of €4.95 (package) or €3.75 (letterbox package) is requested. If the consumer does not choose this, the shipping costs will be at his own expense.
* Please note: for hygienic reasons, hairpieces (wigs, mustaches and beards, etc.) and party lenses cannot be returned. In addition, helium tanks CANNOT be returned due to auditability.

5.2 You are obliged to check whether the items delivered to your home comply with the order. If this is not the case, you can report this within 14 days via our party store Onlinemart.nl and the item will be replaced or your payment will be reversed if it is shown that you do not accept the item for valid reasons.

5.3 In the exceptional case that an item is sent to you that does not correspond to the order, Onlinemart.nl reserves the right to replace the item with a new one or to return the amount paid. In this case, Onlinemart.nl will pay for the return shipping costs.
